9th year H1 Extension after I-140 denial

Hi all,

My I-140 got denied 2 months ago. I am in the process of re-filing the same thru a different attorney.

My 8th year H1 extension was filed and approved last year when the labor was pending. Now my labor is no longer pending. It was approved on Aug 24, 2006.

1) Is there a problem if I file for my 9th year H1 extension even though my labor is no longer pending ?.

2) Or, do I need to re-file my I-140 first before I file for the H1 extension?

Basically, do I need to have "some" process pending while filing for H1 extension. ?

labor need not be pending, even if it is approved i guess you can file for H1 extension. this time you should get 1 yr extension.

this is my interpretation.

gurus correct me if I wrong.
