My sister is currently on OPT but has been unemployed for about 5 months since she started her OPT. We did not realize about the USCIS rule that a proof of employment has to be submitted within 90 days. Does this render her 'Out Of Status'?
Does she have to immediately return to India? If she finds work within the next month or so, would she still have a chance to file for H-1B?
Also, does this affect any future visa applications for the visa, i.e. H-1B, L1, H4 or L2?
