90 days for RFE response

My company attorney is taking the sweet time to 90days
before he replies to my RFE-EVL.
I have tried to talk to him, my HR, Director and still
no results.they have allready spent 70 days doing nothing
and now they say they will file response next week end
These guys do not realize the pain we go through with these
RFE.
Immigration officers must realize what they do.
It is unfair to select some for RFE and approve the rest without.
All should get their cards without the RFE nonsense.
First take 3 yrs to clear the baclog and then send RFE to some like me
working for stupid corporations where they just don't get it.
Any body can you beat that.
I am so frustrated with this.

Just walk in to your lawyers office and say that you will mail the RFE response that the lawyer prepares personally and will not leave until then. That should do the trick.

If the USCIS is providing corporations with a free retention program, the companies will take it anyday! I can understand the frustration, just hang in there...

Bani,
You are not alone. My RFE was issued on 2/24, but no actions since then. I tried everything I could do. The good thing is, if you have to wait, you only have 20 more days to wait. Hopefully your lawyer will reply your RFE soon.

In the service center processing web site, it says:

"If the service Center asked yo to submit more information or evidence and you submitted in more than 60 days ago, and you have not received a decision yet, you can call the national customer service center at 1-800-375-5283 for a case status referral."

So, I think you can ask for the status referral youself. You can also show your lawyer this and ask him to do so. Hope this helps.

I am also on delay. The lawyer said "You are approved". He based this on the stupid "on line" message and response from the 800 number. I waited through all of March for the approval that I knew was not coming. Hopefully, the lawyer will now respond to my request and submitt the response to the RFE. He wanted to wait 60 days.

Why did you guys go with the company lawyer? Because it was free? I think it's worth the money to hire your own attorney for your immigration case, because he/she will work for you, not for the company. There's conflict of interest here, the company usually wants to make this process last as long as possible, because they know once you get your GC you're free to leave or make demands regarding your job/position.

You should get your own lawyer to respond to the RFE for you.

Behaviour of some lawyer.

I had tough time with company appointed lawyer.

I took the following actions :-

1.Never give any kind of gift. You are client and they should serve you better.

2. Once I realized, the lawyer is not good enough, I demanded the copy of everything they sent to INS. They did not reply to my request. I went there personally and had good argument.

3. Lawyer asked - why do I want copies ? I said it is my right to have copies and considering another lawyer that is prompt.

4. The lawyer indirectly asked for more money for speedy actions. We agreed on response time of one week for any document or anything that needs to be taken care of her. She agreed.

She took two weeks for RFE response but paralegal had some personal issues. But RFE response was mailed by Fed-ex and complete.

Be assertive and firm with lawyers - they are working FOR you At the end money is going from your pocket - company may pay it but they deduct it from annual salary or use GC processing fee as means to give you less salary.

In this specific case - I would not wait till next week. I would go and talk to lawyer - polite BUT firm and assertive.....

If I were you, I would go to HR and get EVL (format is available on this site, mention salary, position, intent ot hire AFTER GC approval and job description which is similar to the one filed in LC) then mail to USCIS. Then wait for atorney to respond in his own sweet time.

When USCIS receives two responses for RFE then that are not going to deny you RFE.
