9 weeks after n400 interview and today went for infopass...

Hi guys
It has been 9 weeks after my n400 application for naturalization interview and nothing so far , i was handed n652 with decision can't be made at moment, so today i went for infopass to follow up and was told that they are conducting a background check and are waiting for results , is this normal? as for as i know background has to be done before an interview correct? . So guys please let me know what you think or maybe you have had same experience , any advise will be much appreciated and thanks in advance !

I read that they can do the interview before the background check is completed. It might have happened in your case.

Did they tell you when you should expect a decision from them? As far as I know, they are required to give a decision within 120 days after the interview.

Back in 2006 USCIS adopted a policy of not scheduling a naturalization interview until all the background checks have been completed:

As far as I know, that policy is still in effect. Occasionally the make a mistake and schedule a case for an interview before the background checks are finished, but this is fairly rare. It is more likely that something else is going on.
Since in your erlier posts you indicated that your previous N-400 was denied and that you had a 2009 arrest, your application would have required a supervisor review after the interview before it could be approved.

It seems likely to me that your case is still stuck in some review stage, perhaps just sitting in the IO's desk waiting to be acted on.
As noted above, the USCIS is required to make a decision on your application within 120 days of the interview.
(After that you could file a 1147(b) lawsuit to force them to adjudicate your application).

In the meantime I suggest that you contact the U.S. Representative for the area where you live and both the U.S. Senators for your state and ask them for help in finding out what's happening with your application. Members of Congress routinely make such inquiries to USCIS as a part of their constituent services, and each member of Congress will have instructions on his/her website on how to submit a constituent services request.
Sometimes an external inquiry of this sort will be enough to dislodge a stuck case, and, at least you'll get a more substantive response this way about what is really happening with your application.

Thank you guys very much for your responses and your input, yes i was arrested in 2009 but was never convicted nor i went to the jail , i did provide court dispositions to the io at the interview ,as you u know from my previous posts that I've had horrible experience with my io ,the only thing i can think of is my name , I've got a common Muslim name Ali and maybe that has triggered an extra background check , i will wait few more weeks until i hit 90th day and i'll contact my congressmen and maybe an ombudsman as well , at the infopass the io din't tell me when it will be done all the keep talking about is we have 120 days and i'm like i don't want to get to that point where i have to sue them and wait again for long time as i'm really exhausted .
