8th year H1B extension based on Pending I-140

Friends,

I need your help...! I am on 7th year H1B extension based on a pending I-140 (RD:09/05/2003). My H1 is valid till 03,2005. I have used a Sub. labor for this I-140 and have no clue why it is getting so much delayed.

The question I have is whether to apply the 8th year extension now itself or give it some time to see if I-140 gets approved....! I would be paying for the lawyer and H1B fees (around $1000). Also shoould I go for Premiuim($1000 additional) or regular processing ? I have already spent almost $10,000 for this crazy GC process and don't know how much more.......:(

Welcome to the club. I have just applied for the 9th year extension. Already crossed the $10K mark last time checked( in 2002 ). I just did it to be on the safe side.

I-140 RD OCT-7-2003
I-485 RD NOV-21-2003
FP1 -- OCT-21-2003
EAD/AP about time to renew.

Have you applied as premium or regular ? I did 7 th year as premium but now have some more time in hand so giving thought to regular :confused:

My 8 th year will expire in march 2005, Just submitted all the papers for 9 th year to my company, My company will file for 9 the year in 2 to 3 weeks.
Last month my State Labor is cleared . Now it is in ATL DOL. In the mean time i applied GC in My wife's name Her labor is cleared both state and federal in 5 months. last month we went for FP. Waitng for this one to be cleared otherwise i have to pay for the the things that i have to take care of the last part.

I did premium as I have to have my DL renewed by Jan 3 05.
My lawyer actually didn't charge me anything this time around. Just the regular petition fees + $1k for premium.
 
Question

Any reason why you guys are not applying for the EAD instead of renewing the H1? If you have applied for the I140 and I485 concurrently then you are eligible for the EAD.And renewing the EAD is a lot cheaper than applying for a H1. Plus it might be a lot faster.
Or am I missing something?! :confused:
 
People want to maintain H1 status until they get there green card to be safe. There is a lot of discussion avaiable if you would search. Bottomline it is advisable to maintain H1 not that you need to. So pay a little extra now if you dont want to suffer due to any untoward adjudication of your case. Choose your pick!!
 
I asked my lawyer the same thing but he suggested not to apply h1 extension since it's not necessary, too many payment that overlap. Though my case is simple and straightforward and I have a stable job in a stable company.

What do you mean that your lawyer has problems wrt payments???
Also in my experience in the US there are no "STABLE" jobs.

I am going ahead with H1B extension as regular processing.

What happens if the I-140 is deined while the H1B extension is pending ? Is H1B extension also denied or it can still get approved as it was applied while I-140 was pending ?

If the I-140 is denied then any other petition which depends on its validity is automatically denied. This is just confirmed from my lawyer.

Calling USCIS for status check....!

My Attorney has submitted a status check inquiry on 12/16 for my I-140. I have not got any updates yet.

Would it be a good idea if I call the National Service center number ? Has any one called directly before and what was the responce ?
