8th year H1 extension & H4

Hi,

I need to apply for my 8th year H1 extension. My wife is on H4 with me here in US. Once we get the H1 approval notice, both my wife and I are planning to go to Chennai for stamping.

Do we need to apply for H4 extension along with my H1 extension application ?. Or, is my H1 approval notice with the docs proving that she is my wife, enough for her to get the H4 stamped ?.

No Need to apply for H4 extension, if you Planned to go out of Country with in H4 expiration time period ... She will get H4 stamped based on your H1 Approval..

Thanx for the reply. My 7th year H1 extension is not stamped yet. (We never left the country after getting the 7th year extension.) And it will expire in the next 4 months. Both my wife's and my visa stamping expired 8 months ago.

While filing for my 7th year extension, my employer told us that there was no need to file for H4 extension coz if we were to leave the country while on 7th year extension, we would need to get the 7th year extension stamped, and along with it, my wife's H4 would also get stamped.

And now my employer is getting ready to file for my 8th year extension. Again, no H4 extension is being filed. And if we are to leave the country after 4 months, then I would need to get the 8th year extension stamped, and along with it, my wife's H4 would also get stamped.

He said that as long as there is NO H1 transfer (meaning changing employers) happening, we don't need to file for H4 extension since it is always tied to my H1.

I just want to confirm this. Thanx !
