My previous employer filed for my PERM certification 365 days before the expiry of 6year period. Though labor was approved, I-140 was not filed. My previous employer however obtained 7th year extension based on the labor certification (though the labor was approved and I-140 was not filed).
During 7th year, I moved to my current employer. My current employer filed for my 8th year h1 extension, based on approved labor from my previous employer, and the petition was denied. I guess the reason was that my old labor certificatio had just expired.
My current company is also pursuing labor certification for me, and will file for I-140 after labor approval. Supposing that labor is approved and I-140 is filed before expiry of H1B 7th year, can my company apply for 8th year H1 extension?
