8 types of Security Checks ??? Your thoughts, please

I got stuck with Name Check for one and half years. I finally recevied a letter from FBI that they finalized my NC in December. In response to the inquiry, I then recevied a letter from USCIS stating that "The investigation into your background checks remain open".

In November, I recevied a letter from my senator office that my file is pending because of pending NC results from FBI.

My attorney's assistant spoke with the USCIS representative yesterday. They confirmed that my NC Is complete. They said that NC is one of the 8 checks they do. They will have to complete processing on all security checks to move forward.

I am confused. Is this a new process? Are you aware of this 8 types of security checks? Anyone else has recevied the same response from USCIS.

Please share your thoughts.

I think with NSC you can't be sure of anything. Everytime they give different reason. I think there are only two options.

1) Keep waiting and keep calling the service center, Ombudsman, Congressman, Senator etc. till they adjudicate.

2) The second option is slightly risky. File WOM and bring sudden end. With WOM, decision could go either way.

Why do you think that 2) is a risky option? If the case is legit they cannot deny.

If the judge forces US Attorney to decide on a case, sometimes if USCIS has genuinely not able to do the NC, they will rather deny such a case than approve.

And one more thing. Immigration is a benefit you are seeking and it is not a right. You have to have friendly judge or an AUSA. There was a case listed here wherein one guy's got his wife's I-485 denied after WOM. Reason - Somehow they said his wife is already a citizen because she was in the electoral roll (she was not). The story goes like that...Many more such stories are there in this forum.

Well, they have to have a basis in the law to deny a case. Just because they are not able to do the NC is not an excuse. If you were an IO would you spend time fighting with an attorney if you knew you don't have a case in the first place? Of course you can always face a person who had a bad lunch. Everywhere.

Luckyone2000,
Even though your name check has been finalized, your fingerprints might have expired ( they expire 15 months after they are taken). So, you might get a new biometric (FP) notice very soon, and once your fingerprints are okay (which get usually finalized within a day of ur appointment), you should receive your approval very soon. So, basically, ur background check is still open because of pending Fingerprinting. But this will be done very quickly unlike Namecheck. So, lookout for ur fingerprint notice and you are very close to approval. Good luck..

Ok I have one for you.
My case has been stuck in the security checks forever now.
However On my Infopass I came to that my Name check was completed in sept 2005.IO herself told me the best part is your Namecheck is complete so it is just retrogression that is the stumbling block.
Then nothing happened on my case. My case has been current since a long time.
Info pass after infopass .status remained the same. Then my attorney who has been folllowing up with the local office sent them another letter dated dec4th 2006. I got 3rd FP on dec 23 which was duly done.
On Jan 22 they replied "Pending Security are not complete." hence the case is pending.........
Now one begs to ask that why when security checks were pending did you ask for my FP's . Isnt that awaste of the tax payers money.

USCIS is unpreditable and unexplained to a lay person like us..........
They have thier own laws own rules and own jurisdiction.

greenerpastures - Thanks for the response. This sounds encouraging to me. I exactly got the same response from my congressman's office yesterday. He said that my FP has just expired and I will be getting a new one soon. Just have my fingers crossed.
