Hi Friends,
I applied for I- 485 in March 2006 and it is still pending with Texas Service center with a status of visa number not available. I have two I-140s with priority dates as follows.
1. First I-140 with priority date of 12/26/2000(EB2)
2. Second I-140 with priority date of 09/03/2002(EB3).
As per the 8 CFR 204.5(e) regulation, I can retain my old priority date to my I-485 which means I retain 12/16/2000 priority date. Since the current cutoff date of EB3 is 05/08/2001, I should be current right now and I should have a visa number.
so I am calling TSC and talked with them like 20 times, but no result. My lawyer told me that I should be approved by now. so he also has written a letter to TSC. I even faxed a letter to TSC Director and also to I-485 EB supervisor.
so can any one of you are in the same boat like me. Please advice if you pandits know anything about this.
