My H1b was rejected at the london counsulated because the lady refused to accept that h-1 can extend over 6 yrs. She even threatened to invalidate my h1 with DHS, said that they should not have given it in the first place. UK is not my country of residence. Can anyone advise?
1) Should i go back to the counsulate in UK and try again, if so what documentation do i need to take?
2) Or should i return to my home country and try there?
3) Will the fact that they rejected me have any bearing?
Thanks in advance

Hmm! I was seriously in the position to have to go though this. But un/fortunately did not have to go though.

Did'nt you have the H-1 petetion filed to BCIS? Within that should be enough documenatry evidence of the legality of the 7th year H1.

With regards to further action, I would suggest consulting your attorney.

Yes, i had all the documentation, but she refused to even look at it, saying over and over H1 is valid for 6 yrs only. Will the rejection have an impact on my application if i do so in my home country?

File a complaint with the consulate general . There is a document called AC21 June 2001 memo (search the internet- it might be also in I485 FAQ sections of this forum).
You should try with the UK consulate again, writing to the Consulate general, produce copy of AC21 memo and demand why 7th year extension was refused.
Did she give you a letter why visa was refused? Did you have your proof of LC/140 pending?

This refusal does not have bearing on your applying at a different consulate. Even if you decide to go to a different country consulate, write a complaing to the consulate general, providing copies of all documents.
