7th yr H1 X-fer/Ext thru Company-B while i-485 pending.

I have i-140 approved and i-485 pending and have EAD too. But I'm still on H1 since I haven't been able to file my wife's i-485(visa numbers unavailable and she's on H4). My 6yr term completing in March '06 and I know I can extend my H1 with the current employer for 3 more yrs. I have an offer from another company, so my question is can I transfer/extend my H1 through this new company? Will it affect my GC approval in any way if I do ?
I was told it would invalidate my whole GC process, is that true?

Same situation

Hi Rahul,

I am almost in the same situation. So far this board is my main information source, I have not consulted an attorney. Reading posts from other members it looks like we should be able to get 3 years extension with new employer while applying for AC21 at the same time. Where did you hear contrary? Did some attorney tell you it will invalidate the GC process?

I have not consulted an attorney yet. Some of my friends here told me and I'm not sure how credible that info is. I'll let you know if I have more information.
 
Very similar situation

Hi

I am in a similar situation but I-140 is not approved yet. But I would like to know if it will at all be possible if I-140 is approved to switch jobs using H1. I need to keep an H-1 because of marriage to spouse in the future who will be then applying for H4.

We would appreciate if any of the experts know if this could be done.

After looking up more, I see that clearly you can use AC-21 law.

I think it is totally allowed using AC-21.
