7th yr H-1 extension?

Everytime I disect my EB1-OR petition letter trying to find some element that may provide an aota of hope to get an RFE, it gets dashed!!!

Need yr feedback.

My H-1B 6 yrs expires Dec 08. If my EB1-OR gets denied before Dec 2008, but my NIW is pending as of Dec 08 (given the current processing times at NSC), and if I switch to H-4 in Dec 08 to maintain my status, will I be able to get a 7th yr H-1B when the NIW is approved sometime in 2009? Technically this would be have to be a change of status from H-4 to 7th year H-1.
