7th yr extension

Hi,

I am working for employer B.My previous employer A is filing for I-140,485. I have approx. 15months on my H1. Now who has to file for my 7th yr extension.Current employer has filed for labour recently.

Whichever employer holds your H-1 (I assume your current employer) needs to file to extend it.

the conditions for 7th yr ext are
1. the labor pending for atleast 365 days.
2. I-140 pending


in ur case if the substitute labor is already approved, then u can apply for ext only after u file for I-140 based on its oending status. Approved labor cannot be used to file for ext.
