7Th year of H1 and Travel abroad

Hi All,

I will be soon entering the "7th" year of my H1. My Labor has been filed from NY DOL in RIR catagory some 20 months back.
So I am eligible for 7th year of H1.

I was reading some where on web that one can not travel outside USA after you get on to this 7th YEAR extension.
The reason being one gets a Approval Notice but no VISA is stamped on the passport so once you go out you can not enter the US again.


Is that true ? What happens if there is an emergency and one has to travel ?

I'm aware of those posts. My advise to you is IGNORE THEM. Extensions in 1 year increments (7th, 8th etc) are no different from the 1st 6 years in terms of travel, getting a visa stamp etc.
 
U sure can travel. My friend travelled after getting 7 th yr extension - stamped 7 th yr extension visa in the home country and came back - now is on 8 th yr extension.

I have posted similar question at EAD/AP forum but this is my situation:

1. Currently applying for I-485
2. I am on 7th year H1 extension without visa stamped on my passport.
3. I have AP approved.
4. Going to overseas this week due to business trip.

Since I have AP, do I still need 7th year H1B stamped on my
passport for re-entry? If not then, does it mean that I can forget about H1B stamping on the passport as long as I have valid AP which will make me legally re-enter the country? (I am legally able to work because I have 7th year H1 extension approved)

H-1 7th year is nothing different....as long as u get ur passport stamped either at St.Louis or back home, u can travel back.

It used to be the case in 2001 ish time frame, when Sec. Powell had sent a memo to all the consulates against issuing visas for 7th year.
 
When to apply for 7th Yr Ext if you travel to India?

Hi friends,

My six years of H1 is expiring in 28 Mar'04. I would like to know how early/late we can apply for the 7th year extension? My wife will be visiting India for 2 months (Dec'03 & Jan'04), so we are not sure whether to apply for the extension before she leaves to India or after she comes back in Jan'04 (or) apply the H4 for her separately. Any suggestions?
(Also heard that we have to file for the extension with latest I-94)
