7th year H1 Extn...

Hi All,

My current H1 B is expiring in Jul 2005. I do have my EAD but prefer not to use it. My I-485 RD is 03/25/2003 (PD: 03/12/2001) and got my 2nd FP done on 12/28/2004.

As my case would require to use AC-21, am keeping my fingers crossed and not using the EAD.

Should I go for 7th year extn processing (based on a separate LC which is pending for more than a year now) or how long can I wait the maximum to initiate that process as that would cost close to $ 3000 excluding the premium processing fee $1000 ?

Please advise....

Hi Wrangler,

My situation is very similar to yours - RD is 03/21/03 - FP2 done on same date as you! My H1 expires in April 2005.

I am still with same company though (no AC21).


I talked (via e-mail) with my lawyer and she said that we could extend the H1B or I could use EAD. She also said that as long as I apply for H1 extension before the expiry date of the current H1, I would not be considered out of status. So, you may have a little time, I guess - I do not know how the AC21 provisions affect your case though.

Why go through another LC?? Use the same LC/panding I-485 as the reason for the 7th year extension. Has your I-140 cleared? If yes then you are safe. Just apply for the 7th year extension with the currently pending I-485. Talk to your lawyer he/she should be guide you.

I am in a similar situation. My 6 year expires this month end. Sent I-485 RFE response on 12/30 and INS recvd on 1/4. LUD changed upto 1/10 and stopped. My lawyer is saying to wait till 5 days before my H1 expires. Don't know what to do

I am in a similar situation. H1 6 yrs ends April 27, 05. Just sent RFE. Don't know if I should extend H1 or use the EAD. Any thoughts anybody?

If we use EAD for a company who filed I140, can we use the EAD in some other company also or we cannot??

2)i got my 1st EAD and renewal applied for 2 nd EAD.( i never used my EAD)

my questions are
1)i allready applied for 2nd EAD renewal, so can i apply for 7 th year H1 extenstion.
2) is there any difference working on h1 or EAD with the same sponsering company while my 485 in process.

If you are close to or on your extensions then it is better to stay on H1, since if 485 is denied you will be out of status and EAD is void and you cannot work anymore.
