Can I file for seventh year h1 extesnion, based on I-140 pending (pending for 2 weeks) and labor priority date (its more 365 days old)? Not filed for 485.

No you cannot. I-140 should be pending more then 365 days to be eligible..

I did get my 8th year extension solely based upon I-140 pending.

I-140 does n't come into play. Only LC should be pending 1 year.. I had 7/8/9th year ext.s while I-140 is in pending/appeal.

What if Labor is already certified (not pending !) ?

since how long is your I-140 is pending and how old is yourI-140 when you get your 7th year extesnsion?

In my case, I was using substitution (pre-approved) labor which is more than year old.

Hi US11,

Here are the facts of my case and my 7th year H1B extension was approved today!
I am yet to see the paper approval.

1. 6 years expiring end of next month.
2. Applied for renewal in late Apr 03
3. Unable to stand the crawling speed of VSC (at that time) applied for Premium Proc
in June
4. Missed 1 year of labor by a week or two triggering an RFE
5. Employer responded last week
6. USCIS Approved extension today.
7. Labor approved in Jul 03 (approved in Sep 03)
8. I-140 applied in Nov 03 and waiting for approval!!!

So, does that help??
