7th Year Extention

I got my H1b in Dec 1998.

6 years finishing in Dec 2004.

Actually came to USA in May 1999. LC has been pending for 2 years.

Can the request for 7th year extension be filed NOW for May 2006 expiry.

Or do I have get an extension for 5 months and then file a 7th year extension.

Please advise. Thanks.

Your H1 6 year period starts from the day you entered into US. In your case, 6 year H1 will expire in May 2005.

Two Options:
1) Get extension till May 2005 before Dec 2004 and then apply for 7th year.
2) If you already have LC/140 pending for a year (or I-485 pending), apply for extension for a year before Dec 2004.
