Hi ppl,

I have a question with regard to the 7th yr extension. I will tell you my understanding and what i am hearing from all different resources, if someone could clarify will be pretty helpful.

1. 7th yr extension is applicable only if Either Labor is pending for 365 days or I140 is pending for 365 days.

2. 7th yr extension is possible even if Labor is not pending for 365 days, but is approved and 140 has been applied and approved within 6 months and waiting for priority date to be current.

3. My basic question is can you get a 7th yr extension if currently pending labor for 6 months is converted to perm and gets approved before it is pending for 1 yr and 140 also gets approved within say 6 months can i get a 7th yr extension on the basis of labor approved and priority date not being current.

really appreciate any inputs in this regard. please let me know if you need more information.

if you have applied labor (state level) 365 days ago you qualify period. Now if you are into 140 and/or waiting for 485...my understading is you can still claim extension based on the labor filing date...use the labor petition receipt. However if your 485 is denied or 140 is denied I am not sure about the consequences. I am sure they will come up with new plans.

This is my understanding...others pls share your views on this important subject. I suggest you search this forum thoroughly on this subject, my conclusions are based on the experience in reading such info.

Thanks for your reply, see that is what i have gathered in all the time i have spent reading all the threads in these forums, however i am just needed to clarify because i got different views about the fact that if your labor is cleared that irrespective of weather your 140 is pending for 1 yr or less you are eligible for 7th yr extension.

just wanted to clarify that.
