How much time before the expiration of your 6 year term can you apply for an extension ? My 6 yr term expires in March 2003, can I apply for an extension now itself.

The reason why I wld like to apply early is because I am not sure if my labor app will get approved (bay area, lay offs etc). As per the new law, I can apply for an extension if my labor cert has been around for more than a year. However, the new law is unclear on what would happen if the labor cert is not approved eventually.
 
When state DOL receices your application, they give you a date. You qualify for extension only when 365 days have passed that date.

The new law is very clear. It says that at any point if your LCA doesn't get approved or your I140 or 485 is denied, then your extension (suppose you got one) gets terminated. That means your H-1B staus ends.

But hope for the best man and be prepared for the worst.
