7th year extension

My LC was filed on jan 2003. However due to an
oversight on the part of my attorney they filed my 7th
year H1B extension on nov 2003. They should have
waited until FEB 2004. USCIS rejected my applications
on grounds that my LC was not pending for >= 365 days,
the information about the rejection was sent to me on
05/14/2004.

My 6th year H1B ended on 03/04/2004. what are my
options ?

My attorney's are planning to do the following.

1) Although my I797 was issued on march 04 1998, i
came into US only on Jun 08 1998. Based on this can i
appeal for a H1B extension for the period from March -
June 2004 ? if this gets approved, they can go ahead
and file for the 7th year extension in june 2004.

Is this the only viable course of action ? or are
there better ways to appeal a denial of this kind ?

have u seen cases of these kinds before ? If so, I know its a difficult question, What is the probablity of this getting approved ?
