7th year extension

No, one can apply for an extension only before the expiration. If it has expired then application for extension logically becomes irrelevant.

7Th year

7th Year Extension of H1B can be filed anytime as long as you are eligible and satisfy the criteria of Labor or 140 having been filed and is pending for 365 days.

Yes. I would imagine so..

I have filed 8th year extn but with no gap.

Most attorneys suggest having H1 as something to fall back on just in case. In the past some attorneys did say that if 485 is denied then 7th year or 8th year h1 would also be revoked but now they say differently.

Guys correct me if I am wrong.

But for those with EAD and within 6 years window it is better to stop the H1 clock.

My 2 cents..

I used EAD before expiry of 6 years of H1 .
H1 is now expired .

Now i want to use the unsed part of h1 and then get 7th year extension on h1 so as to back up the EAD .

Is that possible ?

If you still have some time left for the six year H1B limit then it might be possible to go back to H1B again and next apply for extension to 7th year. Since your situation is some what complex, it may be better to consult an immigration lawyer for advice based on your situation.

Now that you already have an EAD why would you want to go back to an H-1? I would presume if you have problems with your 485 both your EAD and 7th year H-1 will be impacted, so why take the trouble. But I would suggest that you consult a competent lawyer on that.
