7th Year extension with H if Stat L.C. pending

Help needed!!!

can anyone explain if the new law about the 7th year extension applies if the state level L.C. pending or it has to be Federal level pending or I-140 submitted as pre-condition of the extension?

My H visa is to be expired soon, but still waiting for state level L.C. approval at D.C. They are so slow, slow for 3 years not moving forward. ( rank the slowest L.C. application nation-wide )

It doesn't matter where your LC is pending, state or region.

As long as peding > 365 days, one can request for an extension.
