7th year extension-Urgent - Please Help!!!!

Hi,

My 6th year of H1 will end on Dec 2005. I am in the process of using a pre-approved Substitute labor with PD in Aug 2002.

Lawyer is in the process of filing I-140.
Can I get 7th year extension based on this Labor?

If so will I get 7th yr extension based on approved labor or I-140 receipt?

My understanding is that (realize that this is only my understanding, as I'm not lawyer) once you have filed the I-140 labor sub. with the USCIS you can file the 7th year extension based on the filing of immigration documents (no need to wait for any receipt number). On the I-129 form, part 2 item number 4 you have to provide the PRIOR petition number (your current H-1B case number) by filing ng that into the box and sumbitting a copy. Whan that 7th year extension if filed, you can continue to work on the H-1B (expect the 7th year extension H-1B document to be mailed to you 2-3 months following the extension filing) until the a decision is made about your green card. My understanding is that the approved labor sub. qualifies you for the 7th year H-1B extension.

I have a very similar case as yours and the new company is in the process of filing I-140 and then using the receipt notice will file for my H1B 7th year extension. Do let me know if any issues associated with that process.
