7th Year Extension New Labor - Urgent

I have 2 questions.

1) My I-140 was denied and I have filed an appeal since 6months now. My H1 6th year is coming to an end in 3 months. Do I have to wait till the last moment (last day?) to file a 7th year extension based on the appeal? The I140 is more than 365 days old.

2) I filed a new labor 2 months ago. Which means that its not older than 365 days. If the new LC gets approved, will it be eligible for the extension? I checked the original document for the extenstion criteria, and it says that the LC Should be 365 days or older. It doesnt mention specifically
about the LC being approved or pending.

Does anyone have had success in getting an extension using a LC that was certified before 365 days?

I dont think they will allow extention based on an approved LC if its less than 365. thats for sure.
 
For TC2007

You have to apply H-1B extension based on the original LC / I-140 that you have appealed. The new LC is less than 365 old, so H-1B extension cannot be granted on this one.
