7th Year extension and related questions

Hello,

I am completing my 6 years stay in US on 2nd March 2004. I have a visa that is till August 05, 2004 and my I 94 is also till that date. I have filed for Labor on 5th Feb 2003. I have travelled to India for a period of 4 months in total for different reasons. Now the questions:

1. Can i get an extension for the period (4 months) that i stayed in India? If so how?
2. Can i travel outside of US while on my 7th year extension?
3. When should i file for my 7th Year extension.. .sometime after 5th Feb 2004 or in July 2004.
4. I have heard that it just take 10 days for the 7th year extension.. Is this true?

If you have time, which you seem to have, there's no point trying to recapture those 4 mts.


2. Can i travel outside of US while on my 7th year extension?

Yes, You do need to get a new visa stamp on the p/p to get back though.


3. When should i file for my 7th Year extension.. .sometime after 5th Feb 2004 or in July 2004.

Hmm. How is your stay valid till 8/5 when your H1 6yrs. are expiring in 3/2?



4. I have heard that it just take 10 days for the 7th year extension.. Is this true?

Premium processing will take less then 15 days. Regular will take it's own sweet time.

Yes, You do need to get a new visa stamp on the p/p to get back though.

The reason why i am asking .. i saw an article.. titled.. "Beware Beware Travel Abroad in 7th Year of H1B – June 2001 "

This was the Interpretation:
narrow interpretation of the nature of the extension: only the person's stay in the U.S. is extended, but the H1B petition is not extended. In order to have a visa issued, a person must have a valid petition. Therefore, this interpretation means that a person who has been granted the 7th year extension is not able to travel, because an H1B visa will not be issued.

See.. I changed my employer in 2001 and at that time they applied for h1 transfer and INS gave a 3 yr visa which expires in August 2004. I guess.. INS(at that time) did not check for my first entry to US.
 
I believe that memo is obsolete. But do not have any official confirmation to quite. I wish this was removed from the said website. Creates a lot of confusion.

Many have gotten stamps in India and Canada. Look at some of these postings.
