I had posted about this subject originally - and some said it wouldn't work. Anyway my lawyer tried this and we got an approval! While I don't need it anymore since I am not an H-1B anymore (EAD) it is good to know to have gotten the 7th year extension. Maybe it helps someone out there.
I basically have 2 GC cases going on here. The first had ended (withdrawn I-140) and we thought the H-1B was non-extendable, but wanted to give it a try nevertheless - and got an approval even. The second had no bearing on the H-1B extension as we didn't have that I-140 approval by then.
Now waiting for I-485 approval to be over with this nonesense.
Timeline:
Original 6th year H-1B over middle of January, 2006

Filed I-140 (at CSC) October 2004
Filed I-485 Dec. 2004 (postponed due to wedding)
Laid off from company A Feb. 2005
Company A also withdrew pending I-140
Joined company B in March 2005 (transferred H-1B and
recaptured 6 weeks - so H-1B now until Feb. 28th. 2006).
Company B issues and discriminated against H-1B holders, so quit
Joined company C in July 2005
Filed PERM LC in September 2005
PERM Audit November 2005 (business neccesity)
PERM LC certified December ~12/23/05
Received PERM LC hardcopy ~ 1/5/06
I-140/I-485/I-131/I-765 RD: 1/10/06
Filed H-1B 7th year extension 2/24/06
Company D buys out parts of company C (successor-in-interest)
I-131 approved ~3/6/06
CSC->TSC of I-40/I-485 case
I-765 approved ~3/6/06 - but didn't receive EADs
Infopass ~4/11/06: EAD sent to wrong address - so correct address
EAD cards received ~4/20/06
H-1B 7th year extension approved: 5/4/06
I-140 AD 5/8/06
I-485 AP????(waiting or hoping to pass 180 days of I-485 pending at least)
