7th year extension after I-140 withdrawn

Hello,

can I use the labor filed by company A (PD 4/15/2005) after they laid me off and withdrew I-140 for 7th year extension while I am with company B now?

The reasoning being:
- I-140 didn't get denied - but withdrawal means they could potentially use the underlying labor for someone else
- 5/12/2005 Yates memo specifically provides for 7th year extensions filed while with employer B using old labor from employer A.

Since I am in my 6th year now even filing PERM wouldn't help with 7th year extension anymore now, so it would be beneficial if previous labor could be used.

Yes you can get extn provided old labor is not used for some else.
