Hi,

I got my 7th year extension approved through premium prcessing.
I have to travel out of US during the month of may, the visa stamping that I have in my passport expired last year!

In this situation, Here are mu questions
1) Since this my 7 th year extension, is there any risk involved if i go the consulate for stamping( chennai consulate)?

2)My 6 years expired 2003 December but I got the 7th year from April 2004. This was intentionally done this way by my lawyer, since INS made a mistake and gave me visa till Jan 2005 instead of Dec 2003, when my company applied for H1 transfer.

I am wondering if all these issues(THough I was never out of status even for a day!) will cause any issues at the chennai consulate. Please post your ideas any recent 7 th year experiences with chennai consulate.

Thanks a ton

1. Should not be a problem.
2. Your lawyer does not understand USCIS. Since he is not going to be holding the visa he should have been cautious. You might have trouble in chennai consulate for this (illegal status from dec to April which is more than 3 months- 3 yr bar). Although it can be argued that the visa validity date speaks otherwise, it is the general norm that you count the 6 year limit and USCIS is not bothered about that. A quirky chennai consulate visa officer might throw you out and they are notorious to exactly that.
