Hi

My H1B is expiring in Sep 2013 and it will reach its 6 year cap limit.
I have approved I-140 petition with priority date of June 2010. I have a new job offer that I want to move on with.
When I transfer my current H1B to the new company, am I going to get renewed for 3 years given that I have approved I-140. Or I have to transfer this one first and then file separately for the extension?

Thank you

Same situation!

I am in a very similar position! Can you describe your experience please? Did you get 3 years with the new company? When did you give notice to your old company?

I would really appreciate your help!

Change of employer filed by employer B will be approved as long as I-140 filed and approved by employer A remains in APPROVED mode. Should the employer A choose to withdraw you cannot benefit 7th year H-1B. The only thing an individual remains benefited is priority date.

Thanks for the response, whitemimauz3. My current 6 years of H1b expires in Nov 2013. Can you clarify - as long as employer A does not revoke approved I-140, will employer B get a 3-year visa or a 7-month visa, if they apply now?

As I said in my previous post, If employer A's I-140 is approved and employer B files H-1B change of employer, H-1B will be extended for 3 years.
