Hi:

My h1 6 years term is until 2004 FEB. But when I applied for H1 they gave until 2006.

1. Do I need to leave on Feb’2004?

2. Do I need to stay out the country for one year, if I am returning back? .

3. Still now I did not applied for green card, is there any possibility for H1 extension?


More details:

1. First entered in 1998 Jan First week.

2. Stayed on L1 until Feb ‘1999.

3. After that on H1 till date.

i think L & H visas are not clubbed together.(guys correct me if iam wrong)
Your H visa 6 years starts from the day you used the h1 visa.
so it should be valid till 2006.

H1 extension beyond 6 yrs will be given only if you have applied GC and your labor is either pending for 1yr or is cleared and i140 is applied.

If h1+ l1 duration is not combained it will be 2005 insted of 2006, as I have 1 year/3months of L1 duration.

Now I am confused, when is my exit? 2004/2005/2006?

The time previously spent in H and L is counted toward the maximum if a person changes status from H to L or vise versa. The time is aggregated toward the total time allowed. Accordingly, a person cannot expect to come to the U.S. as an L1A, stay 7 years, and then change to H-1 for an additional 6 years.
