I am in US since May of '98. So my 6 yrs end on May 5th, 2004. In Oct. 2002, I switched company and they filed for H1 transfer. The new H1 is valid till May 2005. I never applied for GC.
My question is: Can I stay beyond May 5th, 2004? What are the implications if I stay? Do I need to get my passport stamped even though I'm not leaving the country?
My company lawyer tells me that since they have given you the new visa, your stay is not illegal in any way. But some people tell me that even though your stay is not illegal, u will have difficulty if u want to come to US in the future.
If I decide to stay beyond May of this yr, and file for GC b4 May, will I be eligible to file for yearly extension after that?
