6 yrs on h1

My h1 was approved in march'97, however I came to US later in june'97. My lawyer applied for h1 extension until june 2003 since 6 yrs in h status are counted based on when one enters US. My h1 extension is still pending which was filed in nov last year and my i-94 is already expired in march.

I am also eligible for 7th yr extn based on lc pending for 365 days or more rule.

Should I go in for premium processing (I will have to pay 1000$ from my pocket)? Are there any issues with h1 extension in this scenario? Any body with similar experience out there or got h1 extension approval for unused time on h1 ?

Go for Premium Processing! They really do get everything done in 15 days, so, in my opinion, it's worth the $1000. I got my extension this way.

And whatever you do, don't be out of status longer than 10 days.

Good luck.

Once you file for an H-1B extension, you are legally allowed to work for 240 days from the date of filing the petition or INS's decision. If you are trying to capture lost time, and if it is less than 6 months it's a pain in the tuss.

If I were you, I would choose Premium Processing by paying $1000. I got my approval in 6 business days. There shouldn't be any issues if your papers are filed properley.
