6 yrs near completion

Hi,

I have 11.5 months left for 6 years period from the date I first entered into US on h1-b . Now I am trying to file my labor certification for green card (RIR). Also I happend to stay in India for 5 months in between.

If my labor is not cleared within this 11.5 months period, is it possible to claim the 5 months that I stayed in India ?...

Can some body please advise me...this is kind of urgent..

The consideration of 5 mnth period is at the discretion of INS. Please consult your attorney.

However, if you file from the faster states, you should be done.
