6 years not completed, I Can file 7th Yr Extension

6 years not completed, 2.5 Months remaining, Can I file 7th Yr Extension ?

Friends Advise me on my issue....

I have valid H1 upto Oct 15th, 2005( by this time 6 yrs not complete ) , Calculating my vacation time out side the country i.e 2.5 Months i.e by calculation it is coming to Dec. 31,2005 to complete Six years.

My question is Do I need another H1 for 2.5 Months ? and then 7th Year or

Can I apply for 7th Year Extension directly? before completing 6 years ? ( ofcourse I -140 is pending for more than 365 days)

suggest me please...

One of my friends was in similar situation. He applied for 4 months (to complete the full 6 years) extension and then 7 the year extension.
 
I applied mine directly for 7th year extension. You can apply 6 month before the experation date. In your case you can apply after April 15, 2005. I would recomend doing it because it could take 2-4 months. Mine was send on 22 of Aug 2004 and I received approval notice in last week of December 2004.

Processing fee will be same for 4 month and 1 year. And because your pending I-140 qualifies you for year extension, why not go for year rather spending processing fee for 4 months and then again for year extension.
