My 6 years on H1 is expiring on July 31st. Its been 2 years since my company applied for my labor, which is still in the State DOL. But now I am going be laid off in October. My Question is :

1. Can I go on H4. My husband is on H1 and his labor is pending for Over a year?

2. can I switch to another company, since my current company has applied for an extension of H1??

Please advise.

You are eligible to seek H1 extension after 6 years even if you change jobs. The LC from previous employer should remain pending though. If he cancels/withdraws LC or uses it as a substitute LC, you cannot claim H1 extension based on that LC.

I am not sure if you can go on H4 beyond 6 years of H1.

Is it possible to file for extension if the original LC was approved and the employer closed shop?

thanks
