6 years completed on H1, Filing New H1 and entry after 1 year exile?

hi,

6 year clock on H1 will max out in Mar'05, I am planning to transfer back to India and rejoin my existing company after new H1 is processed.

QUE: Can my employer file for new H1 under 2006 quota, basically apply for new H1 in april 2005 or do we have to wait 1 year, even to apply?

Here, I understand that entry on New H1 will be 365 days after expiry of old H1.

Any advice is highly appreciated.

You can only apply for H-1 6 months prior to the start date.
