6 year H1 expires on 03/02/2004

Hi all,
My current H1 visa was approved in June 2003 and is supposed to expire on 03/02/2004. My EAD/AP are on hold because of a RFE on 140. I am planning to go to India in Dec end and come back in January. I am planning to get my visa stamped while I am in India. Is it going to be a problem given the fact that I would have less than 2 months on my H1?
Please any advice would be highly appreciated.

NO you should have no problem entering with 2 months of valid visa

but i would suggest you to postpone your trip for sometime atleast till you get AP approved. discuss with your lawyer and decide. nowadays consulates in india takes lot of time and creates lot of problems due to insufficient documents or other issues.
