6 Year Expiring - Can I file a new extension when another extension is pending

My current H1 6 Year limit expires in Jan 2010. I applied for H1 Extension in May 2009. Got an RFE for LCA in Aug, which company replied to. Then again got an RFE last week for exactly the same thing - LCA, which company has already replied.

My PERM Application for my GC was filed last year. When i Filed for H1 Extension it had not been pending for 365+ days, so just requested for 6 months extension. Now my PERM is more than 365 days old, and now I am eligible for a 1 year extension based on the PERM.

My question is: Can I file for an extension based on the PERM, when one extension application is already pending?

Also has any one experienced the same RFE being asked twice?
 
I'm not sure i understand. I dont think you can "conditionally" ask for a 6 month or 1 year extension depending on the number of months for which your PERM is pending. My understanding is that you can either ask for a 1 year extension or a 3 year extension but your start dates for the extension can be adjusted based on when your PERM was filed (i.e. i think you can file for the extension anytime in the 6 months before max out but can only request for a start date thats's 365 days from the date you filed your PERM).

Based on this i am thinking your employer shuld have already applied for a 1 year extension, not just 6 months. Am I missing something? :)
