Due to extrordinary delay in USDOL Chicago and recent date retrogression for filing of 485 for ceratin categories( EB3 ) has made me worried. My company has already applied for 7 th year of my H1 extension based on fact Labor is pending for more than a year now. Case was cleared by SWA and pending with USDOL Chicago with receipt date 07-JAN-2004. Your inputs/help on followings will be greatly appreciated.
1. Starting a New GC Process under EB2 via Company A other than Nebraska Region:
1.1 Is it advisable to file under EB2 though I am holding master's degree in Computers(MCA) and about 10 Years of ERP(6 Years Oracle HR/Payroll) experience. I donot have any PHD or doctorate....
1.2 What's the recent success rate of EB2 Petition getting approved and my chances under EB2 category.
1.3 If Company A agrees to do that then do they need to do H1 Transfer First.
1.4 When I can do H1 Transfer during 7th year
1.5 Is it possible to start GC process by Company A without them needing to transfer my H1?
If they can, I guess still it will be Empoyment based for Future Employee, does INS differentiate processing of such case from Current Employee and If they differentiate and which
one(Current or future) is faster and risk factor.
2. Labor Substitution : If I arrange a Labor that can be used for my skill/exp then
2.1 Can it be used for filing I-140/485 under EB2 Category.
2.2 Do I need to join the company who provided me Labor substitute to pursue my GC process
or it can be done independently till the stage comes where I have to choose which GC process to pursue.
If somebody has labor in Oracle Technology(ERP) that can be used in my case please leave a note on this thread so that I can contact you. If not ready EB2 labor then if you can file/start my GC process under EB2
