5 years befor my residency

i have got my permanent residency since abril (2005) through
my father he is usc. I have been married
since jan 2000.(5 years befor my residency) Can he get the following-to-join benefit ?
He is in Canada right now as a refufee clime and he has no valid passport , and I am in the US.

If he is eligible, what is the process that I need to take?

are u talking about your husband?
I am really confuse of your story, coz u never mention about yr husband, u just told us yr father is a USC

can u tell us more about yr background?
 
my father(he is USC) sponssored me and i am in US right now wating for my GC since abril (2006) . I have been married since jan 2000. Can he(my husband) get the following-to-join benefit ? He is in Canada right now as a refufee clime and he cann't get a vaild pasport coz he's refugee situation
if he can what he suppose to do in this cace?

I think he meets the criteria by your post.

How your husband enter to Canada without a passport? does the Canadian authorities has recognize his refugee status so they can give him a travel document of some sort? Because he will need a passport. For the passport situation you can consult a lawyer.

Please note: This section is only applicable to lawful permanent residents who did not gain their LPR status as an immediate relative (parent, spouse, or unmarried child under 21 years of age) of a U.S. citizen.)

(spouse may be eligible for following-to-join benefits if your relationship still exists and if one of the following is applicable:
*You received an immigrant visa based on your relationship to your U.S.
citizen parent

Did you gain your LPR status as an unmarried child under 21 years of age of a U.S. citizen, or the parent of a U.S. citizen, or the spouse of a U.S. citizen? If not, ignore that part. The section is applicable to you. Your second highlighted sentence does not contradict the first. If you received your immigrant visa based on your relationship to your U.S. citizen parent when you were already married, then you could not have been an unmarried child of a U.S. citizen.
