I was hoping that you will be able to offer some insight into this situation.
I got a new H1B in Oct 08. My employer has not paid me so far. I had a serious conversation with him. He is now saying that he will generate the 5 months pay in arrears and pay the whole amount in the Feb 09 paycheck.
My questions are :
1) Will this Feb 09 paycheck with all the backlog salary put me in legal status
2) Will INS accept this paycheck as proof of being in legal status the entire time ?
3) With regards to Payroll, is there anyway in which my employer can generate the pay in 5 different paychecks one each for all the past months from Oct 08 to Feb 09 since this is anyway supposed to be arrear payment?
4) The employer is suggesting taking a Leave of absence from Oct 08 to Feb 09. Will that put me in legal status through those months?
5) If the answers to these questions are NO, then what can I do to get back into legal status? Will a WH4 help me regain status? Will WH4 help me transfer H1B to a different company?
