I receieved an RFE asking me to submit a copy of I-94 that was issued on 6/15/2003. I do not have copy of that I-94. After 6/15/2003 I have made a couple of International trips and I surrendered the original to the airlines staff. I have my new I-94 issued during my recent entry to US.

What should I do? How should I respond to this RFE?

After each and every international trip, you should revalidate your I-9 with employer and provide a copy of I-94 with updated I-9. If the I-94 USCIS is asking about is your first I-94, then your employer must definitely have a copy and if it was obtained later on due to H1 extension you might have a copy (saying keep for your records on left side of H1 approval notice).

Thanks Rolling Hills and Visak,

Unfortunately, I did not submit a copy to my employer or lawyer. That was not the first one after the H1B approval. I thought, I had a copy but I could not find it. How do I respond? Any suggestions?

I have no idea. That was the trip I was coming from my home country and it was just before I applied for I-485. I believe, I had submitted either a copy or original of that particular I-94. Somehow, I could not find a copy in my file.

USCIS cares about the status of an applicant at the time of filing I485 or AOS. You can get the copy by filing FOIA and reply to the RFE saying the same.

Didn't your lawyer know to send a copy of I94 when filing for AOS? You should also consider getting a new one if he is so bad.

weekend project of searching the whole house was successful. I found a copy of the I-94. NSC received my response on 3/1/2004, LUD change 3/4/2004.
