485 visa numbers

Hi,

i have few question, but i will first introduce myself.

1) from Pakistan on H1B
2) PERM approved Oct 06 EB3
3) I140 filed
4) 6th year ending 2007

questions
1) as i have heard and read i cannot file 485 even after i140 is approved till PD is Oct 06, is that right?
2) how many visa's are available for 2007?
3) i think eb3 category has quota for 28.6%? is that right?
4) 10,000 goes to other workers? (what other workers?)
5) is the left over has some ratio (means each country gets some visa's allocated based on some criteria) based on the country?
6) if 5 is true (does any one know what is that criteria?) and how one can find that how many are left for their country?
7) graduate (non-IT) with post graduate diploma in computer science with
9+ years IT experience can file EB2 how much are chances for success?
8) if 7 has some chances can same employer file eb2 after eb3 approval?

1- yes now the current PD is August 2002. Means that you have to wait God knows how much
2,3,4- No idea
5-I heard that it depends on the country but u r in this case in world category
6- no idea
7- Ask a lawyer you might have chance
8- i think you can file more than 1 case w/ same employer but I 140 also should be repeated.
9- i am not a lawyer

YES

140,000 ( includes are EB categories 1,2,3 and their spouse and children) from all over the world.

YES + any unused from EB2.

4) 10,000 goes to other workers? (what other workers?)
Bachelors + 0 years experience. (I think, not sure)

5) is the left over has some ratio (means each country gets some visa's allocated based on some criteria) based on the country?
Soft country limits of 7% for both (Family + Employment Based)categories , Pakistan is not affected by country limit. Once worldwide EB3 becomes Oct 06 you can file I485.

6) if 5 is true (does any one know what is that criteria?) and how one can find that how many are left for their country?
Do math with above numbers. But you don't know how many applicants before you are in que to use every years numbers. so, hard to predict. Plan a life without GC or EAD.

If you graduation is a four year degree abosolutely you are qualified for EB2. Must have Bachelors (4 years degree) + 5 years before joining your company that is sponsoring GC.
If three year degree from non UK USCIS is rejecting, which is not justifiable and we can go to court to fight against this partiality.

8) if 7 has some chances can same employer file eb2 after eb3 approval?
YES. And you can port your EB3 PD to EB2 if both I-140's are approved,

KNOWDOL , here is bit more detail and i would like to get your openion

my degree is 2 years ( after 10 year of high school and 2 years of intermediate level) total is 14 years (10 years high school, 2years inter, 2 year bachelor)

1 year experience with current employer out of 9+ years (total us experience 5+ years including 1 year with current employer)

questions

1) does it still qualifies for a EB2 , 4 year bachelors?

2) my old company had done evaluation of credentials in 2001 which shows
that my degree and experience are equal to 4 year bachelor degree.

can this help , how much (especially when it is almost 5 years)
