485 Transfered to local office

Hello all:
I just checked the status of my case (ND August 2001). It says the case was transfered to the Memphis District office.
Can anyone tell if we need an attorney for the interview?

It is for your own peace of mind to have an attorney present during an interview. If you are willing to pay a few hours of attorneys fees and your attorney is willing to come, go for it.

However if your case is straight forward and you have all needed documentation, you should be able to go on your own.

What is your exact ND in August 2001?
 
I have been always wondering how and what triggers a case to be transfered to a local office? Or is it that all cases towards the end are transfered to local office and final approval is granted from there.

Excuse me for my ignorance. I thought I had better things to do in life then understand US Immigration Law. Guess not!

Following are some of the several issues that may trigger a transfer to local office (list is not exhaustive):

  1. Job Change using AC-21
  2. Marital status changed within 1 year prior to the filing I-485
  3. Address Changes for self/company.
  4. Possibility for Application Error, including Medicals.
  5. Any pending litigation -- a pending divorce, separation between spouses
  6. I-140 Amendment filings
  7. Multiple I-140 Approvals???
  8. Could not locate the A# for the alien under question at which point the waiver for interview cannot be admitted and the application per se cannot be denied before transferring it to the local office.
  9. Criminal record that would make earlier claims on I-485 tenuous.
  10. Random Quality Control Exercise on INS' part.
  11. "The buck does NOT stop here at TSC," attitude.
  12. Add some spice and life to your sex-life by testing the bonafideness of your marriage (questions during interview have ranged from "Where, when, and how did you kiss last?" to "Do you undress before having sex?")
  13. The stars are not on your side :-(
