If I change to different company in different location, could I have salary lower than I-140/labor salary? It was AC21 case more than 180 days. What about different industry? I mean from Automotive to Snowmobile industry, they are similar. Do they consider same or different?

Nobody knows for sure (no regulations yet!) but industry change should not be an issue. actually this forum hasn't heard many 485 denials due to dissimilarity on job duties.. nonetheless, try ur best to get as close a job desc as possible

salary difference can be an issue, as per aug memos, if the difference is really large.. a 10-15% difference is ok. if ur gap is higher, research O net siet to prove that it is atleast >= prevalent salary for ur job code.

The current prevailing wage is higher than the one on the labor certificate. (Level 2 - I assume, since Master degree I have and LC requires Master degree). I am not sure about the Prevailing wage when I filed LC. Is that OK if I have wage higher than the Old prevailing wage or higher than the OLd/Current prevailing wage in different state?

I was told by some attorney that 5% is the tolerance of the salary range. Anyone know any law for this?

My attorney said I have to stick to salary on LC. Is he right?
