Hi-

I got an RFE on my 485 asking for
last year's tax returns
W2s and 1099s
last 6 month's paystubs.

I did not work the whole of last year and hence don't have a W2. But
My employer (Who filed my GC) is ready to give me an employment letter.
I had medical benefits till Nov last year
I filed joint taxes with my husband last year
I had some income on 1099 last year.

Just wondering what my options are at this time.

Submit your tax returns and form 1099s.
Are you the primary applicant?

I am not sure how to respond to the request for the last 6 months paystubs, if you don't have them.

If you jointly filed your tax then I think it should not be probem, just submit the documentation what you have including your husbands W2 and tax returns papers.

Abt paystubs, just provide them whatever you have like last 2/3 months and for remaining months, you can ask a letter from your employer mentioning your vacation period.

Thanks for your responses folks. Do you think my employer could generate back dated paystubs? Did you see this happen anytime? I just want to know if this is even a possibility before I go ask my employer. I was thinking of getting paystubs from Jan till date. And I have not worked this year either.

If you have not worked this year at all and now you are asking your employer to generate paystubs, wouldn't that be considered fraudulent?
 
I guess that is true. I was just thinking aloud. Kinda desperate looking for any option available.

As per Dept of Labor, a h1 sponsored company has to pay salary, even if a person is on bench and I know lots of desi companies does not follow that law.
 
Now every one will talk like shitt.

This person dont have any pay stub. Give him some suggestion if he can get over this problem. Forget about fraud and all kind of crap. Whoever is saying this carp, will also follow the same activites if he is in same situation. What a double standard and hypocracy.

Now lets get to the point. what about the facts that GC is for future job? Did any one think about that? You dont have to have a job mandatory.

If the employer willing to give future employment letter, the best bate is to collect some back dated pay stub.. thats all. Pay the salary to your empolyer cash, he will raise the back dated pay stub. In fact he is doing a great favor and lots of ppl got their GC this way.
 
Take a chance and ask your employer to generate the payslips from Jan to till date..
Employers generally send the quartely taxes..., so before its late talk to the employer
 
Thanks for your thoughts guys. I read somewhere that once you file your 485 (or after you use your EAD), you don't have to be in a job. Is that true?
