485 RFE on EVL , Laborbadhi and other RFE experienced friends, Please help

Hi friends,

Good or Bad, I have just received the RFE now faxed from the lawyer. It is skin test (that is easy) and EVL. I think they are issuing RFE on all the old cases.

RFE says "Please submit a current employment Letter. This letter should be on company letter head and should attest to the applicants job-offer or continued employment. This letter should state your level of compensation".

My questions are

1- LC salary is $72k. Now the salary is $135k without any benefits . This much increase , will create any problem. I am going to keep the correct salary in my EVL.

Do I have to write an paragraph to justify the increase ( good performance, no benefits etc)

2- Are they asking for Job-offer as well in the RFE?

3- Do I have to send W2s and recent paystubs ( They are NOT asking for it).

4- I am planning to go thru lawyer only , Is it good?

Ditto, I had same RFE (skin test and EVL) firstly


dont send them what they have not asked for.

mention in letter 2 things (current salary and future intended salary your
sponsor is willing to give upon approval of your GC. Mention this).

mention detailed job responsibilities this should match as shown in labor.

showing more salary is fine as long as job title/description/duties are same and consistent with as mentioned in labor cert.

mention full time/permanent employment clause for current emplyment as well as future offer from your sponsor, employer should also mention prospects of future employment in the letter.

Just to let you know, if it helps

I provided EVL:
1- Job description as per ETA-750A (Para-12), cut and pasted on EVL
2- Salary increase (% of increase) - Higher is good - you pay more taxes.
3- Job is permanent, At Will, will continue after GC,....bla, bla....
4- My current designation is different than LC, so I mentioned current designation "ABC" is equivalent to "LC designation" in this setup/organization but the job description and duties are consistent as mentioned in the LC ETA-750A (Para-12).
Interviewer accepted and said "Sounds good", "Perfect".

I will have the standard EVL letter with the actual current salary and the position and responsibilities as per the LC.

I am not planning to send any W2 or Paystubs.
