Situation:
VSC EB2 Labor Sub, 140 Approved, just passed 180 days. Received a RFE for 485 requesting:
1. Employment letter.
2. 2 Months paystub.
3. 2 years tax return.
I already got a better offer from a fotune 500 company with a higher salary that can satisfy LC wage.
What should I do?
A. Stay with my current employer. I called them regarding the RFE, they said I have 3 months to reply, so no rush, they will review the problem, then decide what they can do.
I am not sure what they are going to do, but looks like they want to delay the letter.
B. My latest paystub is about 1 month old (Mar 2005), no most recent one. Not sure this is a problem.
C. My tax of 2004 is low, about $41,xxx, but it matches my H-1B salary.
D. I can join my new employer, ask them to write letter for me, and wait for 2 months to get the latest paystub. Everything will look good, except the tax return. But the tax return is bad anyway.
What should I do? What other options I have? What's the risk?
