Early 2005, my I-140 was denied because a combination of 2 degrees was not considered equivalent to one US degree, as stated in the job requirements (EB2). I-485 had been filed concurrently, so that was denied as well.
My company re-started the whole process with a new EB3 PERM labor cert., which was approved recently. A new I-140 application has now been filed.
Is there any way to reuse the old 485 application with this new 140, and take advantage of an earlier priority date?
Is there a specific window of time during which you can appeal a denied 140 by getting the educational credentials re-evaluated?
Are there any other suggestions?
