I want some opinion as to what I should be doing now.
I am Eb2 India with PD of july 2002 which will be current in nov. I filed my labor in july 2002 which was stuck in philadelphia till april 2006.When the retrogression was going to happen I filed I140/485 concurrently under Eb2 NIW( Which do not need labor)in Sept 2005 and got the EAd and Ap approved. I am a physician working in a MUA area. My 5 years will be completed in december 2006 when I have to respond with evidence of working in MUA. Since my first labor got approved I applied for a new I 140 to make use of the earlier PD and it was approved last week.
The options thst I have now, before I am hit with retrogression again are
1. Use the new I 140 and do CP which might take 6 months, by which time Eb2 may become unavailable.
2.Use the PD of july 2002 from the labor and respond to the NIW 485 RFE and hopefully it will be adjudicated before retrogression hits me again.
3. File a new I 485 with the newly approved I 140 by november 1st. In this case can I use my filing date of the first 485 application to get the new 485 adjudicated? if this is possible then that will be my best bet.
